This document sets out the terms and conditions governing the use of this website www.amiamalia.com and the placement of products through this website.
Please read the Terms, our Cookie Policy and our Privacy Policy (hereinafter collectively referred to as the “Data Protection Policies”) before using the Website and placing orders through it. By accessing www.amiamalia.com and using this Website and/or placing an order through it, you expressly acknowledge the binding nature of the Terms and the Data Protection
Policies and undertake to comply with these Terms, as well as the Data Protection Policies. By placing the order, the consumer confirms that they have taken note of the essential characteristics of the product, the total price, delivery costs, the right of withdrawal and the duration of the contract before concluding it.

These Terms may be modified. You are responsible for reading the Terms and the Data Protection Policies in their entirety, as the applicable Terms and Data Protection Policies will be those in force at the moment of concluding the relevant contract (as defined below) or at the moment of using this Site.

Definitions
Seller = AMI BY AMALIA SRL, with registered office in: Petroșani municipality, Aviatorilor street, block 13, staircase 3, floor 2, apartment 64, Hunedoara county, Romania, registered with the Trade Registry J2017000164207, VAT RO 37073958.
Buyer/Client = natural or legal person placing an order on the site.
Consumer = natural person acting for purposes outside their commercial or professional activity.
Contract = all provisions of the T&C accepted by the client by placing the order.
Terms and Conditions = provisions governing the contractual relations between users and Ami by Amalia SRL. These may be modified at any time.
Order = the client’s intention to purchase AmiAmalia products. The order becomes contractual only after confirmation by the seller.
Products = luxury knitwear items sold by AMI BY AMALIA SRL.
The essential characteristics are presented on each product page: material, dimensions, care instructions. Images are illustrative and minor shade differences may exist without constituting non-conformity. Color representation may differ depending on the screen used. These differences do not constitute non-conformity.
Due to the manufacturing process and textile material particularities, minor variations in color, texture or size may occur and do not constitute a conformity defect.
The choice of size belongs exclusively to the client. Size guides and recommendations provided on the site are indicative and do not constitute a contractual guarantee of fit.
Products made according to the client’s specifications = products manufactured according to the individual choices of the client (personalization). After the production process has started, the order can no longer be cancelled, except with the Seller’s consent.
Personal data = any information identifying directly or indirectly a person.
Data processing = any operation performed on personal data.
Force majeure = external, unforeseeable and unavoidable event (wars, riots, floods, fires etc.).
Intellectual property
All site content is protected by copyright, trademarks and other intellectual property rights.
It may not be copied or distributed without the written consent of AMI BY AMALIA S.R.L.
The Seller does not guarantee uninterrupted operation of the site and is not liable for temporary unavailability, technical errors, display problems, checkout system malfunction, stock or payment authorization issues generated by IT platforms, hosting providers, payment processors or communication networks. In such situations, orders may be cancelled and the amounts paid will be fully refunded.
Communications regarding order confirmation, delivery status, invoicing, account security or other aspects necessary for contract execution represent operational (transactional) communications and do not constitute commercial communications within the meaning of electronic communications and data protection legislation, being sent regardless of the user’s option regarding receiving marketing messages.
Personal data and confidentiality
Personal data is collected in accordance with Regulation EU 2016/679 (GDPR).
They are used for invoicing, personalization of the shopping experience and marketing (newsletter), from which the client may unsubscribe at any time.
The client must keep the account password secure; the seller is not liable for unauthorized use of the account.
Contract, order placement and acceptance
Placing an order represents acceptance of this document. The automatic email confirming receipt of the order does not represent its acceptance. Acceptance of the order occurs exclusively by sending the email confirming acceptance of the order by the Seller.
All orders depend on availability and acceptance. Products in the cart are not reserved.
The email with details does not represent acceptance of the order. The shipping confirmation represents execution of the contract, not the moment of its conclusion.
Estimated order processing time: 10-15 working days (may increase during campaigns). Subsequently, the email confirming acceptance of the order by the Seller is sent.
The Seller may refuse the order if:
- payment is not authorized;
- delivery restrictions exist (incomplete data etc.);
- the personalization request cannot be fulfilled.
Product availability
Products are mainly made to order, for sustainability (“slow fashion”). In case of unavailability after confirmation, the client will be informed and the amount paid will be fully refunded within maximum 14 days.
Product availability is informative. In exceptional cases, the Seller reserves the right not to honor the order in case of stock, production or supply errors, without other obligations than refunding the paid amounts.
If an order contains multiple products and only some are unavailable, the consumer may opt for partial delivery or full cancellation of the order.
Prices and payments
Prices include VAT for the EU and exclude VAT for extra-EU deliveries.
Prices do not include transport and customs duties. For international deliveries, the consumer is responsible for complying with the customs and fiscal legislation of the destination country.
The total price payable by the consumer is displayed before completing the order and includes all costs known at the moment of placing it.
Payment methods: Card, Stripe, PlatiOnline, PayPal, Revolut and other displayed methods. Payment is made in the currency displayed on the site at the time of placing the order. Any exchange rate differences applied by the issuing bank of the card are borne by the consumer.
In case of an obviously erroneous price displayed due to a technical or material error, the Seller has the right to cancel the order and inform the consumer, without additional obligations.
Payments are secured via SSL and the PlatiOnline Stripe, PayPal, Revolut processors.
Ownership of the products transfers after full payment, and risk transfers at the moment of delivery to the consumer.
Delivery
Products are delivered to the address indicated by the consumer/client and may be received by the consumer or a third party designated by them. In any case, delivery will not exceed 30 days from the conclusion of the contract.
In busy periods or during promotional campaigns, the Seller may deliver the products from
the same order in several separate shipments, as they are completed.
Each parcel will be accompanied by a notice regarding the products remaining to be
delivered.
The risk of loss or damage transfers to the consumer only at the moment of physical possession of the product.
The consumer has the obligation to verify the integrity of the package upon delivery. Visible damages must be noted in the carrier’s document. Subsequent complaints regarding transport damage may be rejected.
The client is responsible for the accuracy of the provided data. The Seller is not liable for impossibility of order execution caused by incorrect information entered by the client.
In case of impossibility of delivery due to the consumer’s fault (wrong address, refusal to receive, non-collection), the contract may be terminated and round-trip transport costs may be retained. After confirmation of delivery by the carrier, responsibility over the product belongs to the consumer.
Exchanges
The product can be returned within 14 days of receipt for a size exchange or for replacement with another product.
We will do everything possible to knit according to the measurements, however, please note that natural yarns are flexible, each color behaves and knits differently. The knitting industry has an accepted tolerance of +/- 1–2 cm for each measurement parameter, and in coats, dresses and skirts the length will modify through wear.
We reserve the right to retain 100% of the product value after 2 modifications to accommodate the requested sizing or when the sizing requirements change.
If the client wishes to wait to exchange the product with another from a future collection, the amount already paid may remain in the client’s account until that product becomes available for purchase.
A product may be exchanged with any other product; if the price of the new purchase exceeds the amount of the previous one, the client will pay the difference. If the price of the new purchase is lower, Ami By Amalia S.R.L. will refund the difference to the client.

Right of withdrawal
According to GEO 34/2014, the product may be returned within 14 days from receipt.
For exercising:
– notification at info@amiamalia.com or to the WhatsApp number: +40 770 235 099;
– unequivocal statement transmitted by the consumer regarding the decision of withdrawal;
– sending the product to the return address communicated to the consumer after the notification of withdrawal.
The products must be returned unworn, unwashed and with the labels intact. Products tried on with signs of use, smell, stains, traces of deodorant, makeup or deterioration will not be accepted for return and will be resent to the client. Returns are not accepted for products deteriorated by use.
The consumer is responsible for the diminished value of the products resulting from handling other than that necessary to determine the nature, characteristics and functioning of the products.
Personalized products are excepted according to art. 16 letter c GEO 34/2014.
The Seller will also reimburse the initial standard delivery cost, if it has been paid, except for the supplementary costs generated by the choice of another delivery method than the standard one offered by the Seller. The consumer bears the direct cost of returning the products.
The reimbursement is made within maximum 14 calendar days from the date on which the Seller is informed about the decision of withdrawal. The Seller may postpone the reimbursement until the receipt of the products or until the provision of proof of their shipment by the consumer, taking into consideration the closest date.
The same payment method will be used.

Conformity of products
The products benefit from the legal rights regarding conformity of goods provided by GEO no. 140/2021 regarding certain aspects related to contracts for the sale of goods.
These rights cover exclusively defects existing at the time of delivery and not normal wear or improper use.
Products must be used exclusively according to their intended purpose. Damages caused by improper use, incorrect washing or modifications do not constitute non-conformity.
If the product presents a defect, the client must notify the trader.
The consumer has the right, free of charge, to have the product brought into conformity by repair or replacement, or to a proportional price reduction or termination of the contract, under the conditions of the law.
The notification of non-conformity is sent to info@amiamalia.com or to the WhatsApp number: +40 770 235 099, accompanied by description and photos. The Seller communicates the solution within 14 calendar days. The transport costs related to the non-conforming product are borne by the Seller.
Force majeure
Force majeure means any external, unforeseeable, invincible and unavoidable event that totally or partially prevents the performance of contractual obligations. Included, without limitation: natural disasters, fires, floods, pandemics, acts of authorities, labour conflicts, interruptions of suppliers, carriers, courier services, communication networks, payment platforms or IT systems.
During the existence of a force majeure event, the parties’ obligations are suspended, without attracting contractual liability.
Applicable law
The contract is governed by Romanian law. In case of differences of interpretation between language versions, the Romanian version prevails.
Any disputes shall be settled amicably, and if such settlement is not possible within a reasonable period, they shall be referred to the competent courts, according to the applicable legislation.
The consumer may address the competent courts from their domicile or from the Seller’s headquarters, according to the applicable legislation.
Modification of terms
AMI BY AMALIA S.R.L. may modify the T&C without prior notice, for future orders.
Fraud suspicions
The Seller may refuse or limit orders in case of fraud, abusive use of the site, repeated refusals of receipt, frequent unjustified returns or conduct contrary to contractual good faith.
The Seller reserves the right to refuse honoring future orders of clients who abusively use the right of withdrawal.
Complaints and alternative dispute resolution
Official communications produce effects only if sent to the email address indicated in this document.

Final provisions
Products are intended exclusively for personal use. Resale for commercial purposes without the Seller’s consent is prohibited.
